POSISI KAIDAH FIQHIYYAH DALAM ISTINBAT HUKUM ISLAM (DALIL NAQLI DAN AQLI)

Abstract

This article discusses the strategic role of Islamic jurisprudence (fiqh) principles in the process of istinbat (conviction) of Islamic law by examining their relationship to the basic principles of Islamic law (naqli) (the Quran and Hadith) and the rational principles (legal reasoning and logic). Islamic jurisprudence (fiqh) principles are formulations of general principles derived from Islamic texts and the practices of scholars, serving as tools to facilitate the understanding and application of Islamic law in diverse and dynamic contexts. This research uses a qualitative approach with descriptive-analytical methods to examine the existence, function, and significance of Islamic jurisprudence as a bridge between textual Islamic law and contextual Islamic law. The results of the study indicate that Islamic jurisprudence (fiqh) principles serve not only as practical guidelines for establishing law but also as an integrative medium between text and social reality. Thus, these principles occupy a crucial role in maintaining a balance between the authenticity of Islamic law and the contextual needs of the community in contemporary Islamic legal practice.
